BREAKING!! President Buhari Lands In Court Over Tenure Extension For IGP Adamu
The Nigerian Bar Association has begun legal action against President Muhammadu Buhari over his extension of the Mohammed Adamu’s term as inspector-general of police.
In the suit FHC/L/CS/214/2021 brought before the Federal High Court in Lagos by the NBA’s public interest litigation committee, Buhari, Adamu and the Police Service Commission are named as respondents.
NBA wants the court to assess the constitutionality of Buhari’s extension of Adamu’s tenure as IGP for three months after Adamu on February 1 attained the necessary 35 years of service.
It claimed that it was motivated by an urgent need and sacred responsibility to reaffirm the supremacy of the rule of law in the face of increasing impunity and the apparent unwillingness of government law officers to give proper advice.
The NBA’s stance is that when Adamu entered the required 35 years of service, he ceased to be a member of the Nigeria Police Force.
The extension of his term was deemed “unconstitutional”.
The end of the tenure of Adamu came on Feb 1, when he clocked 35 years of service.
Staff retire according to service rules after clocking 35 years of service or hitting the age of 60, whichever comes first.
Speculation was rife about his successor, and some had been thrown out before a three-month extension to Adamu’s term was declared by the presidency.
The NBA is cautious in the grand scheme of things because the more casually government officials break the statute, the tougher it will be to expect people to be compliant. People will discover sooner or later that their examples will be followed by those they seek to rule by their leaders and public office holders who disregard the laws of the nation they are supposed to uphold, it said.
